TuneKing - Terms of Service

Welcome to TuneKing. By accessing or using our app, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use TuneKing and uninstall the app.

1. Acceptance of Terms

By downloading, installing, or using TuneKing, you confirm that you:

• Are at least 13 years old (or meet the minimum age required in your country).
• Agree to follow these Terms, our Code of Conduct (Section 4), and our Privacy Policy.
• Accept that violating these terms may result in removal of your content, suspension or termination of your access to the app, or any other action pursuant to law.

2. What TuneKing Is

TuneKing is a platform for creating AI-generated songs, sharing them publicly, discovering and listening to songs from other creators, following other users, and favoriting songs you enjoy. Songs are generated using artificial intelligence based on the prompts, lyrics, and styles you provide.

3. Accounts

• You must create an account to generate, share, and interact with songs.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You agree to provide accurate information and to keep it up to date.
• Accounts are for a single person; you may not share, sell, or transfer your account.
• Notify us immediately at the support email if you suspect unauthorized use of your account.

4. Code of Conduct

TuneKing is a shared, public, creative community. To keep it safe for everyone, you agree not to create, upload, generate, publish, share, favorite, promote, or otherwise distribute content — including songs, lyrics, prompts, titles, cover art, profile information, or messages — that:

Intellectual Property & Impersonation

• Infringes the copyright, trademark, right of publicity, or other intellectual property or proprietary rights of any person or entity.
• Uploads, inputs, or reproduces lyrics, recordings, melodies, or other material that you do not own or do not have permission to use.
• Mimics, clones, or reproduces the name, voice, likeness, or distinctive style of a real artist, performer, public figure, or any other identifiable person without their authorization.
• Impersonates any person or entity, or misrepresents your identity or your affiliation with any person or entity.

Hate, Harassment & Safety

• Promotes, incites, or glorifies hatred, discrimination, or violence against individuals or groups based on race, ethnicity, national origin, religion, disability, age, gender, gender identity, sexual orientation, or any other protected characteristic.
• Harasses, bullies, threatens, intimidates, or targets any individual or group.
• Promotes, encourages, or provides instructions for self-harm, suicide, eating disorders, or harm to others.

Sexual Content & Protection of Minors

• Is sexually explicit, pornographic, or obscene.
• Sexualizes, exploits, or endangers minors in any way. We have zero tolerance for child sexual abuse material (CSAM). Such content is reported to the National Center for Missing & Exploited Children (NCMEC) and/or law enforcement, and offending accounts are permanently banned.

Violence & Illegal Activity

• Depicts, promotes, incites, or glorifies terrorism, violent extremism, or graphic violence.
• Promotes, facilitates, or provides instructions for illegal activity, including the sale of illegal drugs, weapons, or other regulated goods.

Deception & Platform Abuse

• Is fraudulent, deceptive, or misleading, including scams, phishing, or content designed to deceive listeners about its origin.
• Spreads misinformation or disinformation that could cause real-world harm (for example, regarding health, safety, or civic and electoral processes).
• Constitutes spam, or artificially manipulates platform features such as plays, favorites, follows, or rankings (including through bots or fake accounts).
• Discloses private or personally identifying information about another person without their consent ("doxxing").

Technical Abuse

• Reverse engineers, decompiles, scrapes, or attempts to extract the underlying models, source code, or training data of TuneKing.
• Circumvents, disables, or interferes with security, content-moderation, or usage-limit features.
• Uses TuneKing's output to train, develop, or improve any competing AI model or service.
• Introduces malware, or otherwise disrupts or overburdens our infrastructure.

We may, at our discretion and without prior notice, remove or restrict any content and suspend or terminate any account that violates this Code of Conduct or that we reasonably believe poses a risk to our users or the platform. You can report content or users that violate these Terms from within the app.

5. Public Sharing & Community Features

• Publishing: When you publish a song publicly, you make it available for other users to listen to, view, favorite, and share within TuneKing. You can change a song's visibility or remove it, though copies may persist in caches or with users who have already accessed it.
• License to operate the platform: By publishing content publicly, you grant BioRust Studios a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, and perform that content for the purpose of operating, promoting, and improving TuneKing.
• Your responsibility: You are solely responsible for any content you create, publish, or share, and for ensuring you hold all rights necessary to do so.
• Following & favoriting: These features are provided for genuine discovery and curation. Do not use them to harass others or to manipulate the platform.
• Reporting: We review reports of content or users that violate these Terms, but we do not guarantee any particular outcome or response time.

6. Content Ownership

• As between you and BioRust Studios, you retain the rights you hold in the songs you create with TuneKing, subject to the license granted in Section 5 and to the rights of any third parties whose material may be implicated.
• You acknowledge that AI-generated content may not be eligible for copyright protection in all jurisdictions, and that other users may independently generate similar content.
• BioRust Studios retains all rights in the TuneKing app, its software, branding, and underlying technology.

7. Purchases, Credits & Subscriptions

• Credits: Generating songs requires credits. You may purchase credits as a one-time purchase through your app store.
• Subscriptions: You may subscribe to receive a recurring weekly stipend of credits and any associated benefits. Subscriptions automatically renew at the then-current price until cancelled. You can manage or cancel your subscription through your app store account settings; cancellation takes effect at the end of the current billing period.
• Credit terms: Credits have no cash value, are not transferable, and cannot be redeemed for cash except where required by law. Weekly stipend credits may expire or may not roll over from one period to the next, as described in the app at the time of purchase.
• No Refunds: All purchases are considered final and non-refundable, except where required by law or by the policies of the applicable app store. You may request a refund by emailing the support email, or through your app store where applicable.
• Modifications: We may update pricing, features, credit costs, stipend amounts, or plans with prior notice. Continued use after a change takes effect constitutes acceptance.

8. Limitation of Liability

Service Availability: We do not guarantee uninterrupted or error-free access to TuneKing. TuneKing and its service are provided "as is" and "as available," without warranty of any kind. Without limiting this, we expressly disclaim all warranties, whether express, implied or statutory, regarding the app and the Service including without limitation any warranty of merchantability, fitness for a particular purpose, title, security, accuracy and non-infringement. We are not responsible for content created or shared by users, and you access user-generated content at your own risk.

9. Termination & Account Suspension

We reserve the right to suspend or terminate your access, and to remove your content, if:

• You violate these Terms or our Code of Conduct.
• You engage in harmful, illegal, or disruptive behavior.
• The app or its service is discontinued for any reason.
• For any reason.

Upon termination, you may lose access to your account, your content, and any unused credits.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of TuneKing after updates means you accept the new Terms.
